| چکیده | ||
| یکی از ادله اثبات دعوی، نظر کارشناسان و اهل خبره است. در این پژوهش تلاش شده است تا با بررسی مبانی فقهی و اصولی این موضوع در فقه امامیه و فقه عامه و همچنین در حقوق برخی کشورهای عربی، میزان حجیت و اعتبار نظر کارشناس روشن شود. با تحلیل مباحثی همچون حجیت خبر واحد در علم اصول و اعتبار نظر قائف و مترجم در فقه، نشان داده می‌شود که نظر کارشناسی دارای پشتوانه‌ای اسلامی است و می‌توان آن را از ادله اثبات در نظام حقوقی اسلامی دانست. از آن‌جا که ابزارهای اثبات حق، وسیله تحقق عدالت و احقاق حق‌اند، لازم است در نظام حقوقی اسلامی نیز طرق ایصال به حق، ماهیتی اسلامی داشته باشند تا فرایند احقاق حق منطبق بر مبانی شرع باشد. بدین‌سان، بررسی تاریخی رجوع به اهل خبره و اعتبار نظر آنان در کتاب، سنت و عقل، می‌تواند حجیت نظر کارشناسان را به عنوان یکی از ادله معتبر اثبات در حوزه‌های حقوقی و کیفری به اثبات برساند. | ||

| Legal Validity of Experts Decisions in Shiite and Sunni Jurisprudence along with a Comparative Study in Arab Countries | ||

| The judgment or decision of the experts is one of the evidences substantiating claims. The present article is an attempt to study the foundation and authority of this issue in the Shiite and Sunni jurisprudence, as well as the law of some Arab countries. Investigating some relevant issues in jurisprudence and principles of jurisprudence such as the authority of non-mutawatir tradition and validity of the judgment of experts in physiognomy and translation, the article aims at substantiating the point that the judgment of experts has an Islamic foundation, being considered an Islamic evidence toward substantiating claims. This is due to the fact that the means of substantiating rights are the ways of adjudication. So, in an Islamic legal system, the ways of achieving rights should be Islamic if we expect to have an adjudication recognized by Islam. As a result, the study of the historical background of referring to experts’ views and judgments and their legal validity in the Quran, the Sunnah, and the intellect can easily prove the legal validity of this issue as one of the evidences substantiating claims in civil as well as criminal cases. | ||
