| چکیده | ||
| اگر هدف اصلی قواعد مسئولیت مدنی را جبران خسارت‌های مادی و معنوی زیان‌دیده و ترمیم زیان وارده بدانیم، دولت و کارمندان دولت نیز از این قاعده مستثنی نخواهند بود. ممکن است اعطای حق مصونیت و عدم مسئولیت به دولت موجب ایجاد برخی خسارات مادی یا معنوی به اشخاص حقیقی یا حقوقی شود. آیا در صورت امکان، جبران خسارت وارد بر این افراد یا کسب رضایت از آنان واجب است؟ یا این‌که آن‌چه بر آنان وارد شده به هدر رفته و لازم نیست جبران شود؟ و در صورتی که جبران آن خسارات واجب باشد، آیا این جبران بر عهده نظام و از اموال عمومی است یا بر عهده دولت یا کارمند دولت؟ در این مقاله ابتدا مفاهیم مربوط به موضوع تعریف می‌شوند و سپس مبانی مسئولیت مدنی و مبانی نظری مسئولیت یا معافیت دولت و کارمندان دولت در حقوق ایران و فقه امامیه در دو فصل مجزا مورد مطالعه قرار می‌گیرند. | ||

| If the main objective of the rules of civil liability is the compensation of material and spiritual damages, the state and civil servants would not be exceptions to this rule. It is possible that granting immunity to the state may give rise to the imposition of certain material or spiritual losses on natural as well as legal persons. Is compensation for the losses imposed in these cases, or drawing their consent as far as possible, obligatory on the state? If such compensation is necessary, is it the obligation of the political system and the public treasury, or the obligation of the state or the civil servant? The present article first defines the concepts related to the topic and then discusses the foundations of civil liability and those of the liability or immunity of the state and civil servants according to Iranian law and Shiite jurisprudence. | ||
