| اصطلاح و ساختار حقوقی تبدیل تعهد میراثی از رومیان است که در حقوق بسیاری از کشورها به یادگار مانده است، ولی این نهاد سابقه‌ای در حقوق و فقه اسلامی نداشته است. در حقوق ایران این نهاد در ماده 292 قانون مدنی پذیرفته شده است. در این مقاله به بررسی تبدیل تعهد به اعتبار تبدیل دائن در حقوق ایران و تفاوت آن با انتقال طلب خواهیم پرداخت. با توجه به لزوم مطالعه تطبیقی در این خصوص، این دو نهاد به‌طور مختصر با حقوق مصر نیز تطبیق داده می‌شود. در بخش اول ابتدا مفاهیم، ماهیت، شرایط و آثار تبدیل تعهد به اعتبار تبدیل دائن بررسی شده و در بخش دوم به‌صورت مختصر با انتقال طلب به عنوان نهاد دیگر ایفای تعهد آشنا خواهیم شد. سرانجام بخش سوم به مقایسه این دو نهاد اختصاص یافته است. | ||

| The legal term and institution of alteration of debt is handed down from Roman law, surviving in many legal systems of different countries. However, there is no trace of this institution in Islamic jurisprudence and law. In Iranian law, this institution is adopted in Article 292 of the Iranian Civil Code. The present article studies the alteration of debt in terms of the alteration of the creditor in Iranian law and its difference from the cession of claim. These two institutions will also be compared with Egyptian law. The first part deals with the concepts, nature, conditions, and consequences of alteration of debt in terms of alteration of creditor. The second part briefly studies the cession of claim as another institution of satisfaction of obligation. The third part presents a comparative study of these two institutions. | ||
