| بحث پیرامون معضلات نظری عدالت حقوقی در گرو تبیین دقیق مفهوم عدالت است که از مهم‌ترین مباحث مربوط به حوزه فلسفه اخلاق، حقوق و سیاست و تحقیق درباره آن به لحاظ رتبی مقدم بر هرگونه نظریه‌پردازی در مورد عدالت است. این امر نیز به نوبه خود، «تبارشناسی» دانش حقوق را ایجاب می‌کند تا از این ره‌گذر بتوان به فهم دقیق زمان و چگونگی پیدایش «مفهوم یا گفتمان عدالت» و تأثیر آن در مبانی، منابع و اهداف دانش حقوق نائل آمد. گرچه امروزه ارزش عدالت به مثابه امری مسلم مورد قبول همگان قرار گرفته است، لکن نباید غافل بود که این مفهوم نیز چون بسیاری از مفاهیم دیگر مسبوق به عدم بوده و در پی تحولاتی که در نحوه زندگی و اندیشه انسان به وجود آمده، وارد ذهن و زبان بشر گردیده است. به دیگر سخن، عدالت به مثابه یک مفهوم یا گفتمان امری این‌جایی و اکنونی است و به سختی می‌توان از فرازمانی، فرامکانی و فرازبانی‌بودن آن سخن گفت. مقاله حاضر می‌کوشد، سیر تاریخی شکل‌گیری مفهوم گفتمان عدالت را در ذهن و زبان بشر بررسی کند. | ||

| Study of theoretical problems of legal justice necessitates the exact explanation of the concept of justice, which in turn is one of the most significant issues concerning the philosophy of ethics, law, and politics. Thus, researching the concept of justice ranks first among all theorizings on justice. This, in turn, requires studying the genealogy of law through which the precise perception of time, the quality of the emergence of “the concept or discourse of justice,” and its effect on the foundations, sources, and objectives of law may be reached. Although the value of justice nowadays is considered axiomatic and generally received, it should be noted that this concept has also been, like many other concepts, once absent from the social life of people. However, following the developments occurring in the lifestyle and thought of man, this concept entered his mind and language. In other words, justice as a concept or discourse is a human affair. It can hardly be said that justice is a beyond-temporal, beyond-spatial, and meta-linguistic issue. The present article seeks to study the historical process of the formation of the concept of justice discourse in the mind and language of mankind. | ||
