| عدالت از نخستین و اصلی‌ترین دغدغه‌های بشر بوده که در عرصه‌های مختلف زندگی و در چهره‌های متفاوتِ عدل فلسفی، عدل کلامی، عدل سیاسی، عدل اخلاقی و عدلِ حقوقی، اندیشه او را به خود مشغول داشته است. موضوع این نوشتار، گزارش تحلیلی و بسیار فشرده‌ای از عدل حقوقی، به‌ویژه رابطه حقوق و عدالت از دیدگاه اسلام است. اما دستیابی بهتر و منطقی‌تر به این مطلوب، پرداختن به رابطه حقوق و عدالت از سایر دیدگاه‌ها را ضرور می‌سازد. به‌این جهت، نخست در پیش‌گفتار، به جایگاه بحث از عدالت در فلسفه حقوق اشاره شده است و سپس در مقدمه گفتار اصلی، عدالت موضوع گفتگویِ مکاتب حقوقی تبیین و پس از آن دیدگاه مکاتب حقوق طبیعی و حقوق پوزیتیویستی درباره عدالتِ حقوقی مطرح شده و بالأخره پس از طرح اندیشه کلی اسلام درباره عدالت، به ویژگی‌های عدالت حقوقی اسلام و نتایج حاصل از آن اشاره و تصریح شده است که اگرچه به‌طور مسلم عدالت یکی از مبانی و با نگاه دقیق‌تر، یکی از اهداف حقوق اسلامی است، اما مبنای یگانه و هدفِ وحید آن نیست، پس در ارزیابی قوانین، توجه به دیگر مبانی و اهداف نیز ضروری است. | ||

| Justice is among the primary and foremost concerns of human beings, which has preoccupied them in various fields of life and numerous aspects such as philosophical, theological, political, moral, and legal justice. The present article gives an analytical and very concise report of legal justice, especially the relation of law and justice from an Islamic perspective. However, easy and reasonable access to this ideal requires dealing with the relation of law and justice from other perspectives. Thus, the prelude discusses the position of justice in the philosophy of law. The main introduction explains justice as the concern of legal schools, followed by the perspectives of the schools of natural law and positivist law concerning justice. Finally, having raised the Islamic outlines of justice, the article deals with the features of legal justice in Islam and its effects. The article concludes with the point that although justice is definitely one of the foundations and, rather, one of the objectives of Islamic law, it is not the only foundation or the sole goal of this system. Thus, it is necessary to attend to other foundations and goals while evaluating laws and rules. | ||
