| چکیده | ||
| گفتمان حاکم بر حقوق عمومی نوین را می‌توان به نوعی در اندیشه دولت قانون‌مدار جستجو کرد. مطابق این گفتمان، تمامی نهاد‌های سیاسی کشور باید تابع قواعد حقوقی باشند. در این نوشتار منصرف از بررسی مبانی تحلیلی حاکمیت قانون، به نقل دیدگاه‌‌های متداول مطرح در این حوزه خواهیم پرداخت و امکان‌سنجی این نظریه در نظام حقوقی جمهوری اسلامی ایران را مورد بررسی قرار خواهیم داد و با تکیه بر قانون اساسی، مبانی و اصول اولیه حقوق اساسی ایران و نیز با تکیه بر مبانی و اصول اولیه حقوق بشر به بررسی و تطبیق اصول حاکمیت قانون و مؤلفه‌‌های صوری و مادی دولت قانون‌مدار با شرایط موجود در نظام حقوقی جمهوری اسلامی ایران خواهیم پرداخت. در قسمت دیگر مقاله با بررسی نظام‌‌های مختلف حکومتی به عنوان نظام‌‌های رقیب حاکمیت قانون، به طرح و امکان پذیرش «نظریه نسبیت حاکمیت قانون در نظام‌‌های حکومتی» اشاره خواهیم کرد و به اثبات این امر خواهیم پرداخت که شبهات وارده در خصوص نقض حاکمیت قانون، در سایر کشور‌ها نیز وارد می‌باشد. | ||

| The discourse governing new public law can be traced, in a way, in the thought of the law-oriented state. According to this discourse, all political institutions of the state should follow legal rules. Apart from studying the analytical foundations of the rule of law, the present article refers to current views in this regard and the possibility of applying it to the legal system of the I.R.I. Stressing the constitution, the basic foundations and principles of Iranian constitutional law, and the basic foundations and principles of human rights, the article also studies the principles of the rule of law as well as the formal and material features of the law-oriented state in the legal system of the I.R.I. Studying different governmental systems as rival ones in terms of the rule of law, the second part of the article deals with the theory of relativity of the rule of law in governmental systems and the possibility of accepting it. It concludes with the point that the objections raised concerning the abuse of the rule of law are also found in other countries. | ||
