| در دنیای امروز، سرمایه‌گذاری خارجی یکی از ارکان اساسی توسعه اقتصادی و اجتماعی به شمار می‌آید و حقوق حاکم بر آن دستخوش تحولات گسترده و پیچیده‌ای بوده است. نظام کنونی حقوق سرمایه‌گذاری خارجی حاصل مجموعه‌ای از تغییرات تاریخی و نهادی است که تحلیل ماهوی آن می‌تواند چشم‌اندازی روشن برای ترسیم نقشه راه آینده این حوزه در سطوح ملی و بین‌المللی فراهم آورد. پرسش اصلی این است که چه عوامل محیطی موجب تحول قواعد حقوق سرمایه‌گذاری خارجی در ادوار مختلف شده‌اند و آیا این تحولات همسو با نیازهای واقعی کشورها و مقتضیات اقتصادی جهانی بوده است؟ همچنین در سطح بین‌المللی، رویکرد غالب در ضابطه‌مند کردن سرمایه‌گذاری خارجی چیست و تا چه اندازه می‌تواند آثار منفی احتمالی آن را مهار کند؟ در این مقاله با بررسی تطور تاریخی و مفهومی حقوق سرمایه‌گذاری خارجی، به تحلیل عوامل مؤثر بر این تحولات پرداخته و مسیر آینده نظام حقوقی حاکم بر سرمایه‌گذاری خارجی از منظر ملی و فراملی تبیین می‌گردد. | ||

| In today’s world, there is no room for doubt that foreign investment is considered one of the most noteworthy pillars of economic and social development, and its governing law has undergone massive changes over time. The current legal framework governing the process of foreign investment has been under far-reaching evolution. Deep exploration and substantial analysis of this evolution will yield an enhanced vision, paving the way for providing a roadmap for future regulation of foreign investment at both national and international levels. In this context, some questions arise as follows: under what factors or surrounding conditions has the legal system governing the process of foreign investment evolved in each period? Has the development of rules in the field of foreign investment in different eras matched the existing requirements? In the current period, what is the targeted approach for the regulation of foreign investment at the international level? Can this approach harness or remove the undesirable impacts of foreign investment? In this paper, an attempt has been made to evaluate and analyze the status of regulatory evolutions of foreign investment and to explain its future trends. | ||
