| چکیده | ||
| هیچ تردیدی وجود ندارد که نظم عمومی مفهومی کلیدی از نهادهای داخلی هر نظام حقوقی به‌ویژه نظام‌های حقوقی موضوعه است؛ مفهومی که به‌رغم برداشت‌های مختلف، کارکرد خود را در تمامی گرایش‌های حقوقی اعم از داخلی و بین‌المللی بازی می‌کند و سایر نهادها و قواعد حقوقی را در نسبتی معنا‌دار با خود سامان می‌دهد. نظم عمومی می‌تواند انجام یک قرارداد را کان‌لم‌یکن و معلق سازد و یا موجب جرم‌انگاری گردد، حقوق و آزادی‌ها را معلق کند یا اختیارات مقامات عمومی را در شرایط خاص افزایش دهد و از طرف دیگر، اجرای تمام یا بخشی از یک کنوانسیون را ملغی کند و حتی موجب اقدام متقابل نظامی و قهریه گردد. در مقابل، در حقوق آنگلوساکسون با مفهوم خط‌مشی عمومی مواجه هستیم. مفهومی که از ارزش‌های اساسی و باورهای حقوق عرفی حمایت می‌کند. بااین‌همه، ماهیت این دو نهاد حقوقی هم به‌تنهایی و هم در نسبت با یکدیگر مبهم و ناشناخته است. این مقاله قصد دارد تا مفهوم نظم عمومی را در دو نظام حقوق موضوعه و آنگلوساکسون به جهت کارکردهای مشابه، تحت دو عبارت متفاوت بررسی نماید. مطالعه‌ای که مبتنی بر نظریه‌های دانشمندان حقوقی در هر دو نظام حقوقی و کاربردهای تقنینی دو مفهوم «نظم عمومی» و «خط‌مشی عمومی» صورت گرفته و نشان می‌دهد خط‌مشی عمومی برداشتی خاص و منطبق بر تحولات و تعاملات جدید حقوقی است. | ||

| There is no doubt that public order is a key concept in the domestic institutions of any legal system particularly the statute ones. In spite of its different conceptions, this concept plays its own role in all legal fields whether domestic or international regulating other legal institutions and rules in a significant relation with it. Public order can make a contract null and void, cause criminalization, suspend rights and freedoms, or increase the authorities of dignitaries in certain circumstances. On the other hand, it can overrule all or part of a convention or give rise to a mutual military and coercive action. In contrast, we face the concept of public policy in Anglo- Saxon law, the concept supporting fundamental values and beliefs of common law. However, the nature of these two legal institutions is far from clear whether by themselves or in relation to each other. The present article seeks to study the concept of public order under two different terms in the statute and Anglo- Saxon legal systems for their identical functions. It is an investigation based on the theories of legal scholars in both legal systems and on the legislative usages of the two concepts of public order and public policy. It indicates that public policy is a special conception corresponding to new legal developments and interactions. | ||
