| چکیده | ||
| امروزه میتوان اسناد تجاری الکترونیکی را بهراحتی در محیطهای الکترونیکی مورد استفاده قرار داد؛ برات الکترونیکی نیز یکی از این اسناد تجاری الکترونیکی است. تلاشهای قانون نمونه آنسیترال در زمینه تجارت الکترونیک 1996 این امکان را برای بازرگانان فراهم آورده است تا از سازوکارهای طراحیشده برای تجارت الکترونیک، از قبیل برات الکترونیکی، بهرهمند شوند. در مورد استفاده از برات الکترونیکی، مسائلی در خصوص «نوشته» بودن برات، نحوۀ انتساب، امضاء، اعتبار حقوقی و شرایط شکلی برات الکترونیکی مطرح میشود. در پژوهش پیشرو، که در نوع خود نخستین پژوهش مفصل در زمینه برات الکترونیکی در حقوق ایران است، به بررسی آن در حقوق ایران، کشورهای خارجی و مقررات بینالمللی پرداخته شده و بر این نظر هستیم که با توجه به مبانی قانون تجارت و قانون تجارت الکترونیکی 1382، میتوان برات الکترونیکی را در ایران مورد استفاده قرار داد و مسائل آن را براساس قوانین موجود مورد تحلیل قرار داد. | ||

| Nowadays, electronic commercial instruments can be easily used in cyberspace. The electronic bill of exchange is also one of these instruments. Efforts have been made in UNCITRAL toward creating a suitable field for increasing electronic commercial relations, so it is possible for merchants to benefit from the mechanisms designed to take advantage of electronic commerce, such as the electronic bill of exchange. In terms of using electronic bills of exchange, issues such as the written form, method of attribution, signature, legal validity, and the formal conditions of the electronic bill of exchange are raised. This article, which is the first comprehensive research on the electronic bill of exchange in the Iranian legal system, deals with the issue in the law of Iran, the laws of foreign countries, and international conventions. We believe that the fundamental principles of commercial law regarding the bill of exchange and the rules of electronic commerce enacted in 1382 can be applied to the electronic bill of exchange in Iranian law and analyzed based on the available laws. | ||
