| چکیده | ||
| یکی از قواعد مهم و پرکابرد فقهی در حوزه معاملات، قاعده «تسلیط» است. این قاعده مضمون حدیث مشهور نبوی (ص) است که فرمودند: «الناس مسلطون علی اموالهم». هرچند سند این حدیث مرسل است، لکن شهرت روایی و فتوایی این حدیث جابر ضعف سند آن بوده و فقها در کتب فقهی به کرات به آن استناد نموده‌اند. همچنین مضمون این قاعده از طریق ادله دیگری چون بنای عقلا قابل اثبات است. در میزان دلالت این قاعده و حدیث سلطنت آراء گوناگون وجود دارد. برخی آن را صرفا دال نفی حجر مردم بر تصرفات مشروع دانسته‌اند. برخی دیگر آن را دال بر تنفیذ عموم تصرفات دانسته‌اند. برخی دیگر آن علاوه بر این، آن را به معنای مشروعیت بخشیدن به اسباب تصرفات و جعل سلطنت برای مالک در اعمال انواع سلطنت دانسته‌اند. برخی دیگر علاوه‌بر این موارد آن را دال بر تسلط مالک بر تفاصیل اسباب مثل عربیت و معاطاتی بودن بیع دانسته‌اند. در این نوشتار علاوه بر بیان اشکالاتی بر نظر اول، ادله‌ای بر اثبات مشرع بودن این قاعده و امکان تمسک به آن هنگام شک در نفس تصرف و همچنین اسباب تصرف اقامه شده است. در ادامه مباحث دلالت این قاعده بر تسلط بر نفس و اعضای بدن اثبات شده است. | ||

| One of the most important and most influential rules of jurisprudence in the field of transactions is the rule of "diligence". This is the theme of the well-known prophetic hadith (PBUH). Although the document of this hadith is mursal, however, the reputation of the narrative and reputation of fatwa, compensates for the weakness of its document. The jurisprudents have also cited it frequently in jurisprudential books. Also, the meaning of this rule can be verified through other proofs such as the rational constitution. There are different opinions on the meaning of this rule and the hadith of the "monarchy". Some have merely referred to the denial of the stooges as legitimate possessions. Others consider it to be an act of public capture. Others, moreover, call it the legitimization of the possession and retaliation of the monarchy for the owner in the application of various monarchies. Others, in addition to these cases, have suggested that the owner is dominant in terms of such things as Arabism and prudence.
