| چکیده | ||
| یکی از فروعی که در ذیل مبحث مقبوض به عقد فاسد توسط فقیهان مورد بحث قرار گرفته، مسئله ضمان مالیت در هنگام سقوط یا نقصان آن با فرض بقاء عین است و پرسش از آن است که در هنگام سقوط کامل مالیت یا نقصان آن، صرف بازگرداندن عین به مالک موجب برائت ذمه خواهد شد و یا اینکه فرد ضامن مالیت عین نیز می‌باشد؟ مطابق دیدگاه مشهور فقها در فرض نقصان مالیت، فرد ضامن مالیت نیست اما در فرض سقوط کامل مالیت، شهرتی شکل نگرفته است. نگارندگان معتقدند در فرض سقوط کامل مالیت، قول به ضمان مستند به ادله محکم‌تری است و در فرض نقصان مالیت، قول مشهور فقها قابل پذیرش نیست چراکه وجوه جمعی که توسط مشهور در مورد روایات متعارض این باب صورت گرفته همگی مبتلا به اشکال هستند و باید بین نقصان مالیت ناشی از تلف کامل یک صفت و عدم آن قائل به تفصیل شد. | ||
