| چکیده | ||
| برخی از اعمال حقوقی با وجود ایجاد در عالم اعتبار و شناسایی آنها توسط شرع و قانون، دارای اثر فعلی نیستند و تا ضمیمه شدن شروط و اجزای ضروری مکمل خود، فاقد ترتب آثار قانونی لازم هستند. این‌گونه اعمال به صحت تأهلی صحیح محسوب می‌شوند هر چند قابلیت صحت فعلی دارند. صحت تأهلی قابلیت شناسایی در کلیه عقود لازم و جایز و ایقاعات مالی را دارد و با مفاهیم مشابه «نظریه اداره قرارداد» و «بطلان نسبی» در حقوق خارجی نقاط اشتراکی دارد لیکن تفاوت‌هایی نیز دارد. اراده، اهلیت و رضا از شروط اساسی صحت تأهلی عمل حقوقی محسوب می‌شود. آثار صحت تأهلی در عقودی که عدم نفوذ موقوف و مراعی دارند متفاوت است. عدم تکوین عقد ممکن است موجب فسخ و بطلان قرارداد شود و یا در موارد نادر بی‌تأثیر باشد. صحت تأهلی در شرط خلاف مقتضای ذات عقد با فرض اسقاط شرط به لحاظ بازشناختن رکن مطلوب و هدف اصلی عقد که قابلیت استواری بدون وجود شرط را دارد موجب بقای عقد می‌شود. ضمان درک نیز بر مبنای نظریه فقهی از آثار صحت تأهلی است ولی در قانون مدنی باید قائل به تفکیک شد؛ هرجا که از آثار عقد فاسد محسوب شده، اثر صحت تأهلی و در موادی که از آثار عقد صحیح شناخته شده باشد از آثار صحت فعلی شمرده شود. صحت تأهلی در ایقاعات مالی فضولی ممکن است از زمان تنفیذ اصیل و در خصوص نمائات، از زمان ایقاع فضولی مؤثر واقع شود. | ||

| Some legal practices, despite the creation in the world of credit and their identification by the Shari'a and the law, do not have the present effect and until the provisions and the necessary components of their complement are annexed, they are lacking a legal effects. These actions are considered to be correct for competency. Although, they have potential for full legal action. All the irrevocable and revocable contracts and financial unilateral acts, can be recognized as correct competency and with similar concepts, "the theory of contract management" and "relative nullity" has shared points in foreign law, but it also has differences. Volition, capacity and consent are the fundamental requirements of competency as legal action. The effects of competency is different in contracts which have "Mora'a" and "Moqouf" invalidity. Incompleteness of contract may lead to the revocation or termination of the contract or, in rare cases, to be ineffective. Competency in condition contrary to the requirement of contract, assuming relinquishing this condition, leads to survival of the contract, In terms of recognizing a desirable element and main goal of the contract, which has the ability to survive without the condition. Assurance of the titles also is effected by competency based on the jurisprudential theory, but in civil cod it should be distinguished; knowing as effect of competency wherever is considered as result of a void contract and effect of authenticity in articles that is considered as result of a proper contract.
